1.2. These Terms and Conditions (“Terms and Conditions”) govern the use of the Website.
1.3. All users and account holders, including those that buy from the website are bound by these Terms and Conditions. By registering, or using the website, you acknowledge that you’ve read, accepted and agreed to be bound by these Terms and Conditions. Should there be any clause in these Terms and Conditions that you do not understand, it is your responsibility to ask YHM to explain the relevant clause to you before you accept the Terms and Conditions or continue using the website. By using this website, it is deemed that, you have unconditionally accepted these Terms and Conditions.

2. Use of Website
2.1. The website is not intended for anyone under the age of 18 years of age. By registering and using the website you are confirming that you are 18 years and older or if you are not legally permitted to enter into a binding agreement, then you may use the Website only with the involvement and supervision of your parent or legal guardian. If your parent or legal guardian supervises you and gives his/her consent, then such person agrees to be bound to these Terms and Conditions and to be liable and responsible for you and all your obligations under these Terms and Conditions.

3. Payment
3.1. YHM is committed to providing secure online payment facilities. All transactions are encrypted using appropriate encryption technology.
3.2. Where payment is made by debit or credit card, we may require additional information in order to authorise and/or verify the validity of payment. You warrant that you are fully authorised to use the debit or credit card supplied for purposes of paying for goods or services on this website.
3.3. If you pay via direct bank deposit or electronic funds transfer, proof of payment must be emailed to YHM, with the correct reference for payment.
3.4. Credit card acquiring and security
3.4.A Credit card transactions will be acquired for Paragon Outsourced Services (Pty) Ltd via Payfast who are the approved payment gateway. Users may go to www.payfast.io to view their security certificate and security policy.
3.5. Payfast accredited payment service provider, and a PCI DSS Level 1 Service Provider
3.6. Payfast PCI SSC Participating Organisation
3.7. PASA System Operator, Payfast is an authorised System Operator with the Payment Association of South Africa (PASA) in terms of SARB Directive 2 of 2007. PASA is the payment system management body recognised by the South African Reserve Bank (SARB), to organise, manage and regulate the participation of members in the national payment system.
3.8. Payfast is a PASA Third Party Payment Provider
3.8.A Payfast Payment Systems is an authorised Third Party Payment Provider with the Payment Association of South Africa (PASA) in terms of SARB Directive 1 of 2007.
3.9. Customer details separate from card details
3.9.A Customer details will be stored by YHM Pty Ltd separately from card details which are entered by the client on Payfast secure site. For more detail on Payfast please visit www.payfast.io.

4. Third Party Suppliers
4.1. You agree and acknowledge that, goods and services on this website is provided by third party person/s or third party suppliers. YHM only provides the platform to facilitate transactions between Third Party Suppliers and users of this website. YHM is neither the consumer nor supplier of goods or services unless otherwise specified.

4.2. Any agreement for services or goods provided by third party suppliers to users of this website is solely between the user of this website and such third party supplier. YHM is not a party to any agreement (whether such agreement is express, written, tacit or by implication) that, may be formed.

4.3. The Third Party Supplier is solely responsible for fulfilment of delivery of the goods or services. The Third Party Seller is also responsible to provide an invoice to the user if required. Not all Third Party Suppliers are registered VAT (Value-Added Tax) vendors. Only Third Party Suppliers who are registered VAT vendors may charge VAT on goods and services sold and issue a tax invoice in respect thereof.

5. Privacy policy
YHM respects your privacy and will take all reasonable measures to protect it, as more fully detailed in our Privacy Policy which is incorporated by reference.

6. Electronic communications
When you visit the Website or send emails to us, you consent to receiving communications from us or any of our divisions, affiliates or partners electronically in accordance with our privacy policy.

7. Ownership and copyright
7.1. 9. Limitation of liability
By use of this website, it is agreed that:
9.1. YHM shall not be cannot be held liable for any inaccurate information published on the Website and/or any incorrect prices displayed on the Website.

11. Governing law and jurisdiction
11.1. These Terms and Conditions and our relationship and/or any dispute arising from or in connection with these Terms and Conditions shall be governed and interpreted in accordance with the laws of the Republic of South Africa. Your continued use of the Website will constitute your consent and submission to the jurisdiction of the South African courts regarding all proceedings, transactions, applications or the like instituted by either party against the other, arising from any of these Terms and Conditions.
11.2. In the event of any dispute arising between you and YHM, you hereby consent to the non-exclusive jurisdiction of the High Court of the Republic of South Africa (Kwazulu Natal Division, Pietermaritzburg) notwithstanding that the quantum in the action or proceedings may otherwise fall below the monetary jurisdiction of that court.

12. General
12.1. You may not cede, assign or otherwise transfer your rights and obligations in terms of these Terms and Conditions to any third party.
12.2. Any failure on the part of you or YHM to enforce any right in terms hereof shall not constitute a waiver of that right.
12.3. If any term or condition contained herein is declared invalid, the remaining terms and conditions will remain in full force and effect.
12.4. No variation, addition, deletion, or agreed cancellation of the Terms and Conditions will be of any force or effect unless in writing and accepted by or on behalf of the parties hereto.
12.5. No indulgence, extension of time, relaxation or latitude which any party (the “grantor”) may show grant or allow to the other (the “grantee”) shall constitute a waiver by the grantor of any of the grantor’s rights and the grantor shall not thereby be prejudiced or stopped from exercising any of its rights against the grantee which may have arisen in the past or which might arise in the future.
12.6. These Terms and Conditions contain the whole agreement between you and YHM and no other warranty or undertaking is valid, unless contained in this document between the parties.
